3. Limited License and Permitted Use
3.1 Subject to these Terms, RVLock grants you a limited, personal, revocable, nonexclusive, nontransferable, and non-sublicensable right to access and use the Scout System for its intended purposes.

4. Restrictions
You will not, and will not permit any other person to:
- (a) copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to discover source code, algorithms, or underlying components of the Scout System, except to the extent prohibited by applicable law;

5.1 You are solely responsible for determining whether the Scout System is appropriate for your intended use, maintaining the Device and related equipment, and ensuring that its installation, configuration, operation, and use comply with applicable law and the Documentation.
5.2 You are responsible for obtaining all notices, permissions, and consents necessary for RVLock to collect, use, disclose, and process Customer Data as described in these Terms and the Privacy Policy.
5.3 You must not rely on the Scout System as a replacement for prudent judgment, physical inspection, regular maintenance, emergency planning, security procedures, or independent monitoring.
5.4 RVLock is not responsible for installation, configuration, service, maintenance, repair, connectivity, or operation performed by you or any third party.
6. Customer Data and RVLock Data Rights
6.1 As between you and RVLock, you retain any rights you may have in User Content.
6.2 You grant RVLock, its affiliates, service providers, partners, successors, and assigns a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable right to host, copy, store, process, analyze, modify, create derivative works from, display, distribute, disclose, and otherwise use Customer Data for:

- (f) complying with legal obligations and enforcing RVLock’s rights; and
- (g) any other business purpose permitted by applicable law.
6.3 RVLock may create, use, disclose, commercialize, license, sell, and otherwise exploit Aggregated Data and De-Identified Data for any lawful purpose. “Aggregated Data” means data combined with other data so that it does not identify a particular individual or household. “De-Identified Data” means data that RVLock reasonably determines does not identify, and cannot reasonably be linked to, a particular individual or household.
6.4 Nothing in these Terms restricts RVLock from developing, acquiring, marketing, or providing products, services, features, or technologies that are similar to or compete with the Scout System.
7. Monitoring and Changes to the Scout System
7.1 RVLock may monitor use, performance, security, availability, functionality, and integrity of the Scout System.
7.2 RVLock may modify, update, suspend, restrict, replace, or discontinue any part of the Scout System at any time, with or without notice. RVLock has no obligation to maintain any particular feature, integration, protocol, compatibility, content, or functionality.
7.3 Updates may be installed automatically. Certain updates may change functionality, require Device replacement, affect compatibility, or cause temporary interruptions.
8. Third-Party Services and Connectivity
8.1 The Scout System may rely on third-party communications networks, wireless carriers, internet providers, device manufacturers, platforms, mapping providers, app stores, integrations, and other third-party services.
8.2 RVLock does not control and is not responsible for third-party services, networks, content, acts, omissions, outages, delays, compatibility issues, security incidents, or changes.
8.3 Third-party services may be governed by separate terms and privacy policies. Your use of third-party services is at your own risk.
9. Fees, Purchases, and Taxes
9.1 Fees, subscriptions, payment terms, renewal terms, and cancellation rights for paid Services will be disclosed at the time of purchase or enrollment.
9.2 You authorize RVLock or its payment processor to charge all applicable fees, taxes, and other amounts due for your selected Services.
9.3 Except where required by law or expressly stated otherwise, fees are nonrefundable.
10. Intellectual Property
10.1 RVLock and its licensors own all right, title, and interest in and to the Scout System, Documentation, RVLock trademarks, software, firmware, data models, analytics, and all related intellectual property rights.
10.2 Except for the limited license expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.
10.3 If you provide feedback, suggestions, ideas, or recommendations about the Scout System, you grant RVLock a perpetual, irrevocable, worldwide, royalty-free right to use and exploit that feedback without restriction or compensation.
11. Disclaimers
11.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SCOUT SYSTEM IS PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS.
11.2 RVLOCK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, QUIET ENJOYMENT, AND NONINTERFERENCE.
11.3 RVLOCK DOES NOT WARRANT THAT THE SCOUT SYSTEM WILL BE UNINTERRUPTED, AVAILABLE, ERROR-FREE, SECURE, ACCURATE, RELIABLE, COMPLETE, TIMELY, COMPATIBLE WITH ANY PARTICULAR DEVICE OR SYSTEM, OR FREE OF HARMFUL COMPONENTS.
11.4 RVLOCK DOES NOT WARRANT THAT ALERTS, NOTIFICATIONS, LOCATION INFORMATION, ANALYTICS, OR OTHER OUTPUTS WILL BE RECEIVED, TRANSMITTED, DELIVERED, OR ACTED UPON AT A PARTICULAR TIME OR AT ALL.
11.5 ANY IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED ARE LIMITED TO THE SHORTEST PERIOD PERMITTED BY LAW.
12. Limitation of Liability
12.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RVLOCK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, BUSINESS OPPORTUNITY, PROPERTY, SECURITY, OR EXPECTED SAVINGS, ARISING FROM OR RELATED TO THE SCOUT SYSTEM OR THESE TERMS.
12.2 RVLOCK WILL NOT BE LIABLE FOR ANY CLAIM ARISING FROM OR RELATED TO:
- (a) user error, misuse, unauthorized access, improper installation, modification, maintenance, or repair;
- (b) power loss, communications failure, internet outage, cellular outage, third-party service failure, or connectivity interruption;
- (c) inaccurate, incomplete, delayed, unavailable, intercepted, corrupted, or lost data, notifications, location information, or alerts;
- (d) third-party hardware, software, services, systems, content, or actions; or
- (e) any use of the Scout System for a prohibited, high-risk, emergency, safety-critical, security-critical, or unlawful purpose.
12.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RVLOCK’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SCOUT SYSTEM OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO RVLOCK FOR THE APPLICABLE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).
12.4 THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, WARRANTY, OR OTHERWISE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
12.5 SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS. IN THOSE JURISDICTIONS, RVLOCK’S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
13. Indemnification
You will defend, indemnify, and hold harmless RVLock, its affiliates, licensors, suppliers, officers, directors, employees, agents, successors, and assigns from and against all claims, damages, liabilities, losses, judgments, awards, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from or related to: (a) your or an Authorized User’s use or misuse of the Scout System; (b) Customer Data; (c) your breach of these Terms; (d) your violation of applicable law or third-party rights; or (e) your installation, configuration, operation, or maintenance of the Scout System.
14. Suspension and Termination
14.1 RVLock may suspend, restrict, or terminate your Account or access to the Scout System at any time, with or without notice, if RVLock reasonably believes you have violated these Terms, created risk or legal exposure for RVLock or another person, failed to pay applicable fees, or used the Scout System in a manner that may impair it.
14.2 You may stop using the Scout System at any time. Termination does not entitle you to a refund except where required by law.
14.3 Upon termination, your right to use the Scout System ends. RVLock may retain, delete, disclose, or otherwise process Customer Data as permitted by these Terms and the Privacy Policy.
15. Force Majeure
RVLock will not be liable for any delay, failure, or interruption caused by circumstances beyond its reasonable control, including natural disasters, weather, fire, pandemic, war, terrorism, civil unrest, labor disputes, governmental action, power or network outages, supply-chain disruption, cyberattack, or third-party service failure.
16. Dispute Resolution
16.1 Informal Resolution. Before initiating a formal proceeding, you and RVLock agree to attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Scout System, or its use (“Dispute”). The party initiating the Dispute must provide written notice describing the Dispute and requested relief. Notices to RVLock must be sent to support@rvlock.com. The parties will have thirty (30) days after receipt of notice to attempt informal resolution.
16.2 Mediation. If a Dispute is not resolved informally, either party may initiate mediation by written notice. Mediation will be administered by a mutually agreed mediation service or, if the parties do not agree within fourteen (14) days, by the American Arbitration Association (“AAA”) under its then-current consumer mediation rules. Mediation may occur by videoconference or telephone unless both parties agree to an in-person session. Each party will bear its own costs and one-half of the mediator’s fees and expenses. Participation in at least one mediation session is a mandatory prerequisite to arbitration.
16.3 Binding Arbitration. If mediation does not resolve a Dispute, either party may initiate binding arbitration by written notice. Arbitration will be administered by the AAA under its then-current Consumer Arbitration Rules, or substantially equivalent rules if the AAA is unavailable, before a single neutral arbitrator selected under those rules. Arbitration may be conducted by videoconference, telephone, or document submission at the election of the initiating party, unless the arbitrator determines that an in-person hearing is necessary for good cause. Any in-person hearing will occur in Salt Lake City or Logan, Utah, or another location agreed by the parties or selected by the arbitrator.
16.4 Arbitration Procedures. The arbitrator will apply Utah substantive law. The arbitrator may award relief available in a court of competent jurisdiction, including individual injunctive or declaratory relief necessary to resolve the individual Dispute. The arbitrator will issue a written, reasoned decision within thirty (30) days after the close of the hearing or final submission. The parties will use commercially reasonable efforts to complete arbitration within one hundred twenty (120) days after the arbitration demand is filed.
16.5 Costs and Fees. Each party will bear its own attorneys’ fees and costs incurred in mediation and arbitration. The prevailing party may recover its reasonable, documented attorneys’ fees and costs, including arbitrator and AAA fees, except to the extent applicable law requires a different allocation that cannot be waived.
16.6 Class Action and Jury Trial Waiver. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND RVLOCK EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, REPRESENTATIVE, PRIVATE ATTORNEY GENERAL, OR OTHER REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING.
16.7 Exceptions. Either party may bring an individual action in small claims court if the claim falls within that court’s jurisdictional limits and is not brought on a class or representative basis. Either party may seek interim equitable relief from a court of competent jurisdiction to preserve the status quo pending arbitration.
16.8 Severability. If any part of this Section 16 is unenforceable, the remaining portions will continue in effect. If the class-action waiver is unenforceable as to a particular claim or remedy, that claim or remedy will be severed and proceed in a court of competent jurisdiction, while all remaining claims proceed in arbitration.
16.9 Opt-Out. You may opt out of this arbitration provision by sending written notice to support@rvlock.com within thirty (30) days after accepting these Terms. Your notice must include your name, mailing address, Account email address, applicable Device serial number, and a clear statement that you decline arbitration under this Section 16. If you opt out, all other provisions of these Terms remain in effect.
17. Governing Law and Venue
These Terms and any Dispute are governed by Utah law, without regard to conflict-of-laws principles. For any action permitted outside arbitration, exclusive jurisdiction and venue lie in the state courts located in Cache County, Utah, and you and RVLock consent to personal jurisdiction and venue in those courts.
18. Mobile Application, Security, and Platform Terms
18.1 Permissions and Compatible Features
The RVLock Scout mobile application may request access to notifications, location, Bluetooth, the local network, the mobile-device camera, photos, files or storage, and the microphone for the purposes described in the Privacy Policy and in the permission prompt presented by your operating system. You may refuse or revoke permission, but a related feature may not be available. You agree not to use any camera, microphone, location, recording, monitoring, or device-control feature in violation of law or the rights of another person.
18.2 Device Authentication and Sensitive Operations
The App may use Face ID, Touch ID, Android biometric authentication, a device passcode, an email verification code, or another supported method to confirm a sensitive operation. RVLock does not receive the underlying facial image, fingerprint image, biometric template, or device passcode. You acknowledge that operating-system authentication confirms that the device accepted an enrolled credential; it does not independently establish that the person is the Account owner.
You are responsible for securing your phone, Account credentials, email account, verification codes, and Devices; limiting who can enroll biometrics or know the device passcode; and promptly removing access from lost, sold, shared, or transferred devices. A short-lived trusted state, including a period of up to fifteen minutes after successful authentication, may be used. RVLock may still require additional verification and server-side authorization, and may deny or delay an operation for security, connectivity, ownership, or legal reasons.
18.3 Locks, Remote Commands, Alerts, and Safety
Remote lock or unlock commands, camera access, alerts, notifications, sensor readings, and other actions depend on power, batteries, radio conditions, internet and local-network connectivity, third-party services, correct installation, and current software or firmware. They may fail, be delayed, be unavailable, or be inaccurate. Always retain a physical means of access where applicable, follow RVLock product instructions, and do not use the Scout System as the sole means of access, security, surveillance, emergency communication, or protection of persons or property.
18.4 Cameras, Audio, and Authorized Users
You are responsible for the placement and lawful use of cameras, microphones, recordings, and sensors, including providing notices and obtaining consents required from occupants, guests, employees, visitors, or other persons. You must not record or monitor an area where a person has a reasonable expectation of privacy, except as permitted by law. You are responsible for access granted to Authorized Users and for removing access when it is no longer appropriate. Before transferring a Device or recreational vehicle, you must unbind it, remove Authorized Users, and complete the documented reset procedure.
18.5 Account Deletion
If Account creation is available in the App, you may request Account deletion through the in-App deletion path described in the Privacy Policy or through the public web resource identified there. Uninstalling the App, signing out, unbinding a Device, or canceling a paid service does not by itself delete the Account. Account deletion may permanently remove or disable access to associated Devices, settings, recordings, history, Authorized User relationships, and other content. Certain information may be retained as described in the Privacy Policy or as required or permitted by law.
18.6 Apple App Store Terms
If you downloaded the App from Apple's App Store, you acknowledge and agree that:
- these Terms are between you and RVLock, not Apple, and RVLock is solely responsible for the App and its content;
- Apple has no obligation to provide maintenance or support services for the App;
- to the extent any warranty applies and the App fails to conform to it, you may notify Apple, and Apple may refund the purchase price, if any, for the App; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App;
- RVLock, not Apple, is responsible for addressing claims relating to the App or your possession or use of it, including product-liability, legal or regulatory, and consumer-protection claims;
- RVLock, not Apple, is responsible for the investigation, defense, settlement, and discharge of third-party intellectual-property claims relating to the App;
- you represent that you are not located in a country subject to a U.S. Government embargo and are not listed on a U.S. Government list of prohibited or restricted parties;
- you must comply with applicable third-party terms when using the App; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
The license in Section 3 is limited, for an Apple-distributed App, to a nontransferable license to use the App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and applicable Family Sharing or volume-purchase rules.
18.7 Google Play Terms
If you downloaded the App from Google Play, Google is not a party to these Terms and is not responsible for the App, its content, maintenance, support, warranties, claims, or compliance with law. Your use of Google Play and Google services is subject to Google's applicable terms. Purchases, subscriptions, cancellations, and refunds processed through Google Play are also subject to Google Play's applicable billing and refund rules.
18.8 In-App Purchases and Subscriptions
If paid digital services or subscriptions are offered in the App, the App will disclose the price, billing period, included features, whether a trial is offered, and any automatic-renewal terms before purchase. Charges processed by Apple or Google are billed to your applicable store account and are managed through that platform. Unless otherwise stated at purchase, an automatically renewing subscription continues until canceled through the applicable store-account settings at least twenty-four hours before the end of the current billing period. Deleting the App or Account does not automatically cancel a store-billed subscription. Refunds are governed by applicable law and the policies of the platform that processed the purchase.
19. Changes to These Terms
RVLock may modify these Terms at any time. RVLock may provide notice through the Scout System, by email, by posting revised Terms, or by another reasonable method. Unless stated otherwise, revised Terms take effect when posted. Your continued use of the Scout System after the effective date constitutes acceptance of the revised Terms.
20. General Provisions
20.1 Entire Agreement. These Terms, the Privacy Policy, any applicable product-specific terms, and any terms accepted through the Scout System are the entire agreement between you and RVLock concerning the Scout System.
20.2 Assignment. You may not assign or transfer these Terms without RVLock’s prior written consent. RVLock may assign these Terms in connection with a merger, acquisition, reorganization, financing, or sale of assets.
20.3 Severability. If any provision is unenforceable, it will be modified to the minimum extent necessary to be enforceable or severed if modification is not possible. The remaining provisions remain in effect.
20.4 No Waiver. RVLock’s failure to enforce a provision is not a waiver of its right to enforce that provision later.
20.5 Survival. Sections 6, 8, and 10 through 20 survive termination or expiration of these Terms.
20.6 Contact. Questions about these Terms may be sent to support@rvlock.com.
